For decades, the companies that make your food have been allowed to decide for themselves whether a new chemical additive is safe, and in many cases never had to tell the Food and Drug Administration at all. On August 10, 2026, Health and Human Services Secretary Robert F. Kennedy Jr. moved to change that.
The Loophole Hiding in the Ingredient List
The mechanism is a provision known as “Generally Recognized as Safe,” or GRAS. It was designed for obvious staples like vinegar and salt, but over time it became the pathway companies used to introduce new dyes, preservatives, sweeteners, and emulsifiers without independent federal review. According to reporting by NOTUS, manufacturers could self-certify an additive as safe and bring it to market with no notice to regulators.
Kennedy’s proposal would require companies to submit information on those additives to the FDA. The agency would have 180 days to review ingredients already on the market and 45 days to review new ones.
What It Does Not Do Yet
The plan is a proposed rule, not a finished one. It is open to public comment before it can take effect, and existing packaged foods would stay on store shelves during the review. For the FDA to mandate pre-market review of additives outright, Congress would first have to grant that authority.
That gap is where the criticism landed. Former FDA Commissioner David Kessler said the proposal does not tackle the root causes of chronic disease. Thomas Gremillion of the Consumer Federation of America warned that a thinly staffed agency could end up rubber-stamping the same ingredients it is meant to scrutinize.

The stakes are not abstract. The additives covered by GRAS are in the everyday packaged foods that fill most American grocery carts, and until now the safety call often rested with the manufacturer, not a regulator.
The comment period is the next checkpoint. Whether the rule tightens oversight or simply formalizes the existing system will depend on what the FDA finalizes, and whether Congress gives it the authority to enforce more than a notification.
